1. About onoff.finance

onoff.finance is operated by Trend IT OÜ, a company registered in Estonia (registry code 12637197, VAT EE101824907) (“we”, “us”, “our”).

onoff.finance provides a user interface that enables individual retail users in the European Economic Area (“EEA”) to buy and sell cryptocurrency using fiat currency. All payment processing, identity verification, and transaction execution are performed by XXX Inc., an independent, licensed, and regulated third-party payment service provider.

By accessing or using onoff.finance, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Eligibility

To use onoff.finance, you must:

• Be at least 18 years of age;
• Be a resident of a country in the EEA that is supported by XXX (see XXX’s global coverage);
• Have the legal capacity to enter into a binding agreement;
• Not be located in, or a national or resident of, any country subject to applicable sanctions or embargo by the EU, UN, or other relevant authority;
• Comply with all applicable laws in your jurisdiction.

We reserve the right to refuse access to any user at our discretion.

3. The nature of our service

When you initiate a transaction through onoff.finance:

• You are entering into a direct contractual relationship with XXX Inc. for the transaction itself.
• XXX is responsible for processing your payment, conducting identity verification (KYC), and delivering cryptocurrency to your specified wallet address or fiat to your bank account.
• We are not a party to the transaction between you and XXX.
• We never hold, receive, or have access to your funds, cryptocurrency, or payment details at any point.

You should read and accept XXX’s Terms of Service before completing any transaction.

4. Non-custodial nature

onoff.finance is strictly non-custodial. This means:

• We never hold or control your cryptocurrency;
• We never hold or control your private keys;
• Cryptocurrency purchased via the platform is sent directly to the wallet address you provide;
• Fiat proceeds from selling cryptocurrency are sent directly to the bank account you provide to XXX;
• You are solely responsible for the security of your own wallet and for providing accurate wallet and bank account details.

5. Identity verification (KYC)

As a condition of completing transactions through XXX, you may be required to complete identity verification. This process is conducted entirely by XXX Inc. in accordance with applicable anti-money laundering (AML) and know-your-customer (KYC) regulations.

We do not conduct or manage identity verification. Any data you provide for KYC purposes is submitted directly to XXX and is governed by XXX’s Privacy Policy.

6. Supported cryptocurrencies and networks

onoff.finance supports all mainnet cryptocurrencies and tokens made available by XXX on the following networks and native chains: Bitcoin, Litecoin, XRP Ledger, Dogecoin, Ethereum Classic, Cardano, Stellar (XLM), EOS, Internet Computer (ICP), Ethereum, Solana, BNB Chain, Tron, TON, Polygon, BASE, Arbitrum, SUI, Hyperliquid, HyperEVM, VeChain, and Avalanche.

The availability of specific cryptocurrencies, networks, and fiat currencies may vary by country, payment method, and applicable regulations. onoff.finance does not guarantee the availability of any specific asset at any time. XXX determines supported assets. Refer to XXX.com/crypto-coverage for the current full list.

7. Fees

Transaction fees are set and charged by XXX Inc. and will be clearly displayed within the XXX widget before you confirm any transaction. We may receive a share of fees as a partner of XXX.

We do not charge additional fees beyond what is displayed in the XXX widget at the point of transaction.

8. Prohibited uses

You must not use onoff.finance to:

• Violate any applicable laws or regulations;
• Engage in money laundering, terrorist financing, or any other illegal financial activity;
• Purchase or sell cryptocurrency on behalf of a third party without their explicit authorisation;
• Circumvent or attempt to circumvent any KYC, AML, or sanctions screening measures;
• Use automated tools, bots, or scripts to access or interact with the platform;
• Attempt to gain unauthorised access to our systems or the XXX widget;
• Use the platform if you are located in or are a national of a sanctioned country.

Breach of these prohibitions may result in immediate termination of access and may be reported to relevant authorities.

9. Cryptocurrency risks

By using onoff.finance, you acknowledge that you understand and accept the risks associated with cryptocurrency transactions, including but not limited to: price volatility, regulatory changes, technical failures, loss of access to wallets, and irreversibility of transactions.

10. Intellectual property

The onoff.finance brand, logo, domain names, and application interface are the property of Trend IT OÜ. You may not reproduce, distribute, or create derivative works from any part of our platform without our prior written consent.

The XXX widget and associated technology are the intellectual property of XXX Inc.

11. Disclaimers and limitation of liability

onoff.finance is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Trend IT OÜ shall not be liable for:

• Any loss of funds arising from your use of the XXX widget or any transaction executed through it;
• Any errors, delays, or failures in the XXX widget or XXX’s services;
• Any loss arising from your provision of incorrect wallet or bank account details;
• Indirect, incidental, special, or consequential damages arising from your use of the platform;
• Any loss arising from cryptocurrency price movements.

Our total liability to you for any claim arising from your use of onoff.finance shall not exceed €100.

12. Availability

We aim to keep onoff.finance available at all times but we do not guarantee uninterrupted availability. We may suspend or restrict access to the platform for maintenance, security reasons, or regulatory compliance without prior notice.

The availability of the XXX widget within our platform depends on XXX Inc.’s services, over which we have no direct control.

13. Termination

We reserve the right to suspend or terminate your access to onoff.finance at any time, without notice, if we believe you have violated these Terms of Service, if required by applicable law, or for any other reason at our discretion.

You may stop using onoff.finance at any time. These Terms of Service will continue to apply to any past use of the platform.

14. Governing law and jurisdiction

These Terms of Service are governed by the laws of Estonia and the European Union. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia, unless you are a consumer resident in another EU member state, in which case you may also bring proceedings in your country of residence.

You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to these Terms

We may update these Terms of Service from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will provide notice via the platform. Continued use of onoff.finance after changes take effect constitutes acceptance of the updated Terms.
